This Criminal appeal has been preferred by Rajesh and Bhola against judgment and order dated 5.3.2010 passed by Additional Sessions Judge/FTC No.1, Kannauj in Session Trial No.240/99, Police Station Kannauj, District Kannauj convicting under sections 452, 324/34 IPC and sentencing them to three months' rigorous imprisonment with fine of Rs.1000/- each under section 452 IPC and two years' rigorous imprisonment with fine of Rs.500/- each under section 324/34 IPC. In default to deposit fine of Rs.1000/- and Rs.500/-, three months and one month's additional rigorous imprisonment each.
According to report of CJM, Kannauj dated 16.3.2018, appellants Rajesh and Bhola have died. Death certificate issued by Ms. Sunita Dohre, Sabhasad, Ward No.1, Nagar Palika Parishad, Kannauj and statements of S.I. Surendra Singh Aarti have been annexed with the report.
No purpose would be served in keeping this appeal pending. The appeal is dismissed as abated.
