This appeal has been preferred by the appellantBramh Pal Singh- against the judgement and order dated 28.5.1998 passed by VII Additional District and Sessions Judge, Bijnor in S.T No.416 of 1996, State versus Bramh Pal Singh @ Bhoore, by which the appellant has been convicted and sentenced to 10 years rigorous imprisonment coupled with fine of Rs.10,000/- in default of payment of fine, two years additional rigorous imprisonment under Section 304 IPC.
Learned A.G.A. has submitted that Bramh Pal Singhsole appellant in this appeal, had died on 12.09.2005 and in view of above, this appeal is liable to be dismissed as abated.
After having heard learned A.G.A. and perusing the impugned judgement and order as well as the entire lower court record, it transpires from the perusal of the report of C.J.M. Bijnor dated 26.05.2018 that Bramh Pal Singh- sole appellant in this appeal, had died on 12.09.2005. In view of above, this appeal stands dismissed as abated.
In view of above, this appeal is accordingly dismissed.
