Heard learned counsel for the parties.
This appeal has been preferred by appellant against the judgment and order of V Additional Sessins Judge, Allahabad dated 4.4.1988 in Sessions Trial No.74 of 1985, State Vs. Thakur Prasad, convicting and sentencing the appellant under Section 307 IPC for 3 years coupled with fine Rs.500/- and in default of payment of fine to undergo further R.I. for 3 months.
From the perusal of the report of the CJMAllahabad dated 17.02.2018 which is on record of this appeal, it transpires that the sole appellant in this appeal- Thakur Prasad Pandey has expired.
Learned A.G.A. has submitted that in view of report of CJM- Allahabad dated 17.2.2018, this appeal is liable to be abated.
In view of the submission made by learned A.G.A. and on perusal of the recitals contained in report of CJM- Allahabad, this appeal is dismissed as abated .
