Heard learned counsel for the applicant and Sri P.K. Giri, the learned Additional Chief Standing Counsel, who has appeared on instructions.
From the instructions placed on the record, the Court notes that the opposite party takes the position that in CH Form-45 the plot in question is recorded as Abadi. He consequently holds that in that view of the matter proceedings under Section 122B of the 1950 Act cannot be continued.
Since the said position has been taken on merits, nothing further survives on this petition, which shall stand disposed of .
