Heard learned counsel for the applicant and learned A.G.A for the State and perused the record.

This bail application has been preferred by the accused applicant, Sharafat, who is involved in case crime no.491 of 2017, under Sections 457 and 380 I.P.C., P.S. Baniyather, District Sambhal.

Learned counsel for the applicant submitted that the applicant has falsely been implicated in this case. He has not committed any offence as alleged in the F.I.R.

He further submitted that the applicant has criminal history of ten cases which have been explained in para-11 of the affidavit filed in support of the bail application.

It is next submitted that the same accused Sharafat has been granted bail by other Bench of this Court vide order dated 13.04.2018 in which the Court perused the criminal history of the applicant. After duly considered the criminal history of the applicant bail was granted.
