Heard learned counsel for applicant, learned A.G.A. and perused the record.

This bail application has been preferred by the accused-applicant, Mohd. Faizan, who is involved in Case Crime No. 81 of 2018, under Sections 420 I.P.C. & 18(c)/27 of Drugs and Cosmetic Act, P.S.- Mandi, District- Saharanpur.

Learned counsel for the applicant in support of his prayer for bail submits that the applicant is innocent and he has been falsely implicated in the present case. The applicant has no concerned with the selling of illegal drugs. The applicant is not the owner of the shop as he is only the servant of the shopkeeper. It is further submitted that the applicant has not committed any offence as alleged in the first information report. No independent witness has come forward to support the prosecution case. The applicant is a poor person and undertakes that if he is released on bail, he will not misuse the liberty of bail granted to him. The applicant is languishing in jail since 13.03.2018.

Per contra learned Additional Government Advocate appearing for the State-respondent vehemently opposed the bail application and submitted that
