Learned counsel for the applicant in support of his prayer for bail submits that the applicant is innocent and he has been falsely implicated in the present case. It is further submitted that so far as the criminal history of the applicant is concerned which has been shown in the rejection order it is categorically stated that as it previously explained the Case Crime No. 1095 of 2009, under sections 498A, 323, 504, 506 I.P.C. and 3/4 Dowry Prohibition Act which is matrimonial dispute and due to this reason the real father-in-law of the applicant moved a complaint before the member of Parliament Prof. Ram Gopal Yadav and hence the instant criminal proceeding is initiated against the applicant without any reason and without any evidence on record. However the applicant has been enlarged on bail in the aforesaid case. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed forth before the court. The circumstances which, according to the counsel, led to the false implication of the accused has also been touched upon at length. It has been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required. It has also been submitted that the applicant is languishing in jail since 03.01.2018. It is further submitted that the criminal history of the applicant has been properly explained in para 23 and 24 of the affidavit filed in support of bail application.
