Learned counsel for the applicant in support of his prayer for bail submits that the applicant is innocent and he has been falsely implicated in the present case and the FIR has been lodged against unknown persons. Subsequently during the course of investigation the police arrested the applicant and false recovery of Rs.16,000/- has been shown against him,which belonged to the applicant. The said fact has been mentioned in paragraph 8 of the affidavit accompanying the bail application.It is also contended that there is no independent witness of the alleged recovery. It is next contended that the applicant is not named in the F.I.R. It is also submitted that the co-accused Shivam Singh has already been released on bail by this court on 9.1.2018; copy of which is annexed as annexure no.4 on page 37 of the bail application. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed forth before the court. The circumstances which, according to the counsel, led to the false implication of the accused has also been touched upon at length. It has been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required. It has also been submitted that the applicant is languishing in jail since 25.11.2017.The applicant has no other reported criminal history except two cases as mentioned in paragraph 8 of the ;affiavit, which has been explained properly..
