The instant bail application has been filed on behalf of the applicant seeking bail in Case Crime No.17 of 2016, under sections 363/302/201/376 IPC read with section 3/4 of POCSO, Police Station Kaptanganj, District Azamgarh during the pendency of trial.
On the case being taken up, no-one has appeared on behalf of the applicant to press the bail application. Learned AGA is present.
The present bail application has been oscillating since the year 2015 with a prayer to release the applicant on bail during the pendency of trial. Mere pendency of the bail application will not accrue any right in favour of the applicant. The bail application cannot be kept pending sine die in the absence of any favourable order operating in his favour. Special significance has been given to speedy and fair trial whereby the life and liberty of the applicant can be preserved.
In the light of above, the bail application is dismissed for want of prosecution.
Let a copy of this order be transmitted to the court below through FAX forthwith to proceed with the matter in accordance with law.
