Heard learned counsel for the applicant, learned A.G.A. for State and perused the record.

As per prosecution version, on 01.03.2018 between 1:00 a.m to 3:00 a.m. applicant with co-accused Mammi Pasi fired on police party and fled away from the spot.

Learned counsel for the applicant contended that applicant has been acquitted in Case Crime No. 127/2017, under Section 3 of U.P. Goonda Act. He is on bail in Case Crime No. 241/2017, under Sections 323, 504, 506, 352, 453 and 308 I.P.C. and in Case Crime No. 141/2016, under Sections 364 and 506 I.P.C., P.S. Raipura, District Chitrakoot. He further contended that the prosecution version is unnatural and unbelievable. Nothing incriminating has been recovered from the possession of applicant. Applicant is languishing in jail since 30.03.2018.

Learned A.G.A. opposed the prayer of bail and contended that there are three criminal cases against the applicant i.e. Case Crime Nos. 241/2017 under Sections 323, 504, 506, 352, 453, 308 I.P.C., Case Crime No. 47/2017 under Section 110G and Case Crime No. 127/2017, under Section 3 U.P. Goonda Act Police Station- Raipura, District Chitrakoot.

Applicant was not arrested on the spot. There is no injury to police personnel.

Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.

Let the applicant Mathura Pasi be released on bail in Case Crime No. 48/2018, under Sections 307, 504, 506 I.P.C. & 12/14 Dacoity Affected Area, Act, Police Station- Mau, District Chitrakoot on furnishing a personal bond and two sureties in the like amount to the satisfaction of court concerned.

Accordingly, the instant bail application is allowed .
