Heard Sri A.K. Mishra, learned counsel for the applicant and Sri Ashish Pandey, learned A.G.A. for the State.
The first bail application of the applicant was rejected by this Court vide order dated 5.1.2016, hence this second bail application has been moved on behalf of the applicant.
The new ground which has been argued by the learned counsel for the applicant is that the applicant is languishing in jail since 8.7.2015 and the trial has not been concluded as yet, hence he may be released on bail
Learned A.G.A. has vehemently opposed the prayer for bail and has submitted that the trial is in progress.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Ajay @ Atul involved in Case Crime No. 420 of 2015 under sections 302 I.P.C., police station Nawabganj, District Allahabad.
Accordingly, the bail application is rejected .
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a further period of eight months from the date of production of a certified copy of this order.
