Heard Sri R.S. Tripathi, learned counsel for the applicant and Sri Ashish Pandey, learned A.G.A. for the State.

The first bail application of the applicant was rejected by this Court vide order dated 19.11.2014 and while rejecting the said bail application the trial court was directed to expedite the trial of the present case within a period of eight months from the said date but till date the trial has not been concluded, hence this second bail application has been moved on behalf of the applicant.

The new ground which has been argued by the learned counsel for the applicant is that the applicant is languishing in jail since 17.10.2013 and the trial has not been concluded as yet and only two prosecution witnesses have been examined, hence he may be released on bail

Learned A.G.A. has vehemently opposed the prayer for bail and has submitted that the trial is in progress.

Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Omkar involved in Case Crime No. 674 of 2013 under section 302, I.P.C., police station Sahaswan, District Budaun.

Accordingly, the bail application is rejected .

However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a further period of eight months from the date of production of a certified copy of this order.
