made to the doctor at page-18 of the supplementary affidavit, part of the medical report dated 25.11.2017, the allegation is confined to Gautam Sharma and Nishu where again the applicant has not been named at all. Learned counsel for the applicant has taken the Court through the statement made to the doctor as also the other statements. The submission of learned counsel for the applicant is two fold; one that the allegation of rape is not at all there against the applicant, but against the coaccused Gautam Sharma alone; and, the other being that the name of the applicant is not consistently mentioned in the vital accounts of the prosecution, where it is missing in the FIR and the statement of the prosecutrix made to the doctor in confidence, during her medical examination altogether, though it finds place in the statement under Section 161 and 164 Cr.P.C. The submission of learned counsel for the applicant, therefore, is that the prosecution case against the applicant stands on infirm and shaky ground, besides the fact that his role is on the fringes. It is also pointed out that no such video, as referred to by the prosecutrix, has been recovered from the applicant.
