The submission of the learned counsel for the applicant is that he has been falsely implicated on account of the fact that the prosecutrix and co-accused Ashish were into an intimate relationship, a fact that was reported by the applicant to her father, much to annoyance. Subsequently, when the prosecutrix eloped with Ashish, the applicant along with Bhoora, a brotherin-law of Ashish, have been falsely implicated. It is pointed out by the learned counsel for the applicant that though, in the FIR, the applicant is also credited with a role of abducting the prosecutrix, but post recovery, the prosecutrix in her statement under Section 164 Cr.P.C., has not nominated the applicant with a role of ravishing her. The allegation of rape is confined to Bhoora and Ashish alone.
