Heard Sri Sunil Kumar Srivastava, learned counsel for the applicant, Sri Abhinav Prasad, learned AGA for the State.

The present application under section 482 Cr.P.C., has been preferred with a prayer to quash the entire proceedings of Complaint Case No.1236 of 2014 (Satyajeet Singh v. Sandeep Jaiswal) under section 138 of N.I. Act, Police Station- Cantt. district - Varanasi pending in the court of ACJM, IXth , Disrtict- Varanasi.

The present case is of a property dispute and lieu of sale, Cheque was given to opposite party no. 2 which was dishonoured/bounced. The proceedings under section 138 of N.I. Act was initiated by the aggrieved party. An application dated 2.11.2018 was preferred by the applicant before the concerned Magistrate with a prayer to permit the applicant to deposit the entire amount in question and the same was allowed by the learned Magistrate. The applicant has filed a certified copy of the application dated 2.11.2018 which he have moved before the learned Magistrate along with receipt of the deposit of Rs. 3,30,000/-.

After having heard learned counsel for the applicant, and perusing the material on record, this Application under section 482 Cr.P.C., is finally disposed off with a direction to the concerned Magistrate to pass appropriate orders on the application of the applicant dated 2.11.2018 within a period of one month from the date of production of a certified copy of this before him.
