Heard Mr. Santosh Kr. Singh Pailwal, learned counsel for the applicant and the learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed challenging the order dated 25.4.2014, passed by the Civil Judge (Junior Division), Court No. 20 Azamgarh in Case No. 597 of 2014 (Sangeeta Vs. Santosh), under Section 12 of the Protection of Women from Domestic Violence Act, 2005 as well as the order dated 30.3.2018m passed in Execution Case No. 792 of 2014 (Sangeeta Vs. Santosh).
Admittedly, against the orders impugned in the present application, the applicant has an statutory alternative remedy by way of filing an appeal under Section 29 of the aforesaid act.
In view of the availability of statutory alternative remedy, this Court declines to entertain the present application. It is, accordingly, dismissed on the ground of availability of alternative remedy.
