Heard Sri Brijesh Kumar Misra, holding brief of Sri Mukesh Kumar, learned counsel for the applicant and learned A.G.A for the State as also perused the record.

This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of Misc. Case No. 1465/11 of 2017 (State Vs. Sanjay), arising out of Case Crime No.302 of 2017, under Section 366 I.P.C., Police Station- Kotwali Fatehgarh, DistrictFarrukhabad, pending before the court of Chief Judicial Magistrate, Farrukhabad.

Learned counsel for applicant states that against the final report submitted by the police on 5.10.2017, the applicant has filed protest petition on 04.12.2017 which is pending before the Chief Judicial Magistrate, Farrukhabad.

Considering the fact that the case is pending and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, without granting any unnecessary or long adjournments to either of the parties, as expeditiously as possible, preferably within a period of three months from the date of production of a certified copy of this order, if there is no other legal impediment.
