Heard learned counsel for the applicant on the application seeking leave to appeal against the judgment and order dated 23.4.2018 by means of which accused respondent Sagar @ Kamal has been acquitted of the offences under Sections 302, 307, 506 IPC.
We have gone through the entire record and also have perused the findings as recorded by the court concerned. It appears that incident is dated 7.9.2015 while the deceased (the brother of the first informant) was travelling in the Magic along with other persons. Even though it has come on record that during the incident itself two other persons namely Gaurav and Devendra also received injuries (pellet wounds). However, the fact remains that none of the injured witnesses has been produced. Perusal of record shows that at the first instance it may be appreciated that as far as PW-3 Mohan is concerned, he is the owner as well as driver of the Magic in question on the date of occurrence and he has been declared hostile. The testimony of PW-3 Mohan has been discussed elaborately on page 13 of the judgment. With regard to the injuries PW-7 Dr. Raviraj has clearly stated in his cross examination that "yadi close range hai yani agar satakar goli mari jaye to jakhm par blackening, tattooing wa charring ayegi". The post mortem report has been clearly elaborated herein as under:-
"जबककि पपोस्टममाटरम मम ऐसमा अअककित नहहीं हहै। ममौकिके किके तथमाकिथथत गवमाह वमाददी पदी0 डब्लल0 1 सकचिन और पदी.0 डब्लल0 4 अकमत तपोमर नके किहमा हहै ककि ममौकिके पर खलन कगरमा थमा। महैथजकि मम भदी कगरमा थमा। पदी0 डब्लल0 5 एस.आई. कचितवन किकममार नके किहमा हहै ककि शव जमदीन पर पडमा थमा परन्तक पदी0 डब्लल0 रमामजदी लमाल कववकेचिकि नके किहमा हहै ककि समादमा कमटदी, खलन आलकदमा कमटदी उन्हपोनके किकेकमकिल जमाजाँचि किके थलयके नहहीं भकेजमा थमा और न हदी मकललजममान किपो कगरफ्तमार किरतके समय उसकिमा किपोई कडस्क्लपोजर स्टकेटमकेन्ट थलयमा थमा। पदी0 डब्लल0 10 एस.आई. शदीओम गमौतम नके थजरह मम ममानमा हहै ककि तमअचिमा उसनके फपोरकेलन्सकि लहैब मम टकेलस्टअग किके थलयके नहहीं भकेजमा थमा। वह नहहीं किह सकितमा ककि तमअचिमा चिमालल हमालत मम थमा यमा नहहीं। गवमाह पदी0 डब्लल0 11 किअवरपमाल जपो बरमामदगदी किमा गवमाह हहै, नके ममानमा हहै ककि किटटमा ककिसदी न चिलमाकिर नहहीं दकेखमा थमा और जपो बयमान न्यमायमालय मम दके रहमा हहै वह पहलदी बमार दके रहमा हहै। पहलके ककिसदी किपो नहहीं बतमायमा।"
The court concerned has further observed that as far as person with regard to whom the fire is said to have been made by placing gun on his shoulder is concerned, he has been produced as defence witness and has completely denied the prosecution story. As far as witness Yash Kumar is concerned,
he is the witness of Panchnama. Apart from PW-1 Sachin Tomar, no other witness has supported the prosecution case. Even though as per the prosecution case itself at the time of incident along with deceased other persons were also present but none of them has been produced. The court concerned has clearly observed herein as under:-
"उक्त सके यह तपो स्पष्ट हहै ककि घटनमायम अपनके समाममान्य क्रम मम हपोतके हहयके नहहीं कदखतदी। यकद 8-10 कदन पहलके झगडमा हहआ थमा और उसकिपो गमाजाँव वमाललों नके शमान्त किरमा कदयमा थमा और यकद यह भदी ममान लके ककि मन हहै मन अकभय क बदलमा लकेनमा चिमाहतमा थमा तपो इन 8-10 कदन मम इस क्रम मम किकछ न किकछ हपोनमा चिमाकहए थमा। कफर भदी यकद उसके बदलमा लकेनमा थमा तपो उसनके घटनमा स्थल किके थलयके ऐसमा स्थमान व समय क्यलों चिकनमा। एकि चिलतदी हहयदी महैथजकि वहैन थजसमम ममृतकि किमा भमाई और उसकिके पररवमार किके लपोग एवअ अन्य 20-25 लपोग भदी बहैठके हलों। कदन दहमाडके सकबह किके 9-9.30 बजके दलसरके किके किअधके पर तमअचिमा रखकिर किनपटदी सके सटमाकिर ममृतकि किके भमाई किके समामनके गपोलदी ममारनमा, यह सअदकेह पहैदमा किरतमा हहै और उससके भदी आगके बढ़किर यह घटनमा किमा समाममान्य प्रवमाह नहहीं दशमारतमा ककि हत्यमा किरनके किके पश्चिमात दपो कदन बमाद वह गमाजाँव किके हदी ककेत्र मम उसदी किटटके व किमारतलस किके समाथ गमाजाँव किके हदी बललकि ममृतकि किके पररवमार किके एकि व्यकक्त किअवरपमाल किके समक पकथलस किपो कमलतमा हहै। किकल कमलमाकिर यह एकि थसअगल कवटनकेस पर आधमाररत ममामलमा हहै थजसमम ममात्र वमाददी म क दममा सकचिन घटनमा किके उक्त रुप मम घटनमा हपोनके किमा किथन किर रहमा हहै ककिन्तक वमाददी म क दममा किकी कवश्वसनदीय बमारबमार उसकिके बयमान बदलनके और घटनमाओअ किके समाममान्य क्रम मम न हपोनके किके किमारण कवश्वसनदीय प्रतदीत नहहीं हपोतदी हहै। कवथध व्यवस्थमा वदीरथसअह बनमाम स्टकेट आफ यल0 पदी0, 2014 (681), 15 एस 0 सदी0 मम यह कनधमा र रत ककियमा गयमा हहै"
" जहमाजाँ उसनके किहमा हहै ककि ममामलमा शमान्त हपोनके किके पश्चिमात मन हदी मन मम दकश्मदी ममान लदी। यह हत्यमा किके हकेत क किपो समाकबत किरनके मम सकम नहहीं हहै। गमौरव व दकेवकेन्द्र किपो छरर लगनके किकी बमात किहकिर कफर यह किहनमा ककि छरमार नहहीं बमारुद लगमा थमा। बमाद मम किहमा ककि बहैठके बहैठके गपोलदी ममार ददी, कफर किहमा ककि दपोनलों डमालके पर खडके थके, कफर किहमा ककि दकेवकेन्द्र किके किअधके पर रखकिर गपोलदी किनपटदी सके सटमाकिर ममारदी गयदी ककिन्तक जख्म पर ब्लहैकिकनअग, टहैटलइअग व चिहैररअग किमा न हपोनमा।"
"पअचिमायतनमामम किके गवमाह दमारमा यह किहनमा ककि पअचिमायतनमाममा भरके जमानके तकि अकभय किमा नमाम नहहीं पतमा थमा, इससके प्रथम सलचिनमा ररपपोटर समय कवपरदीत प्रतदीत हपोनमा अकभयपोजन किथमानकि पर सअदकेह उत्पन्न किरतमा हहै। पअचिमायतनमाममा किके गवमाह और ममौकिके किके अन्य गवमाह यमा तपो कडस्चिमाजर किरमा थलयके गयके अथवमा बचिमाव पक किकी ओर सके प्रस्तकत हहए हह और वह व्यकक्त थजसकिकी महैथजकि मम यह समारदी घटनमा हपोनमा किहमा गयमा हहै, वह पकद्रपोहदी हपो गयमा।"
Thus, the court concerned after discussing the entire evidence on record has concluded herein as under:-
इसदी सन्दभर मम यह भदी स्पष्ट हहै ककि अकभय सके जपो किटटमा बरमामद किरनमा किहमा गयमा हहै, उसकिमा घटनमा मम प्रयपोग ककिसदी भदी रुप सके समाकबत नहहीं हपो पमायमा हहै क्यलों ककि ममौकिके पर किपोई
ऐसमा खपोकिमा किमारतलस नहहीं कमलमा। अकपतक कववकेचिकि नके यह ममानमा हहै ककि न तपो उसनके खलन आलकदमा और न हदी समादमा कमटटदी किपो और न हदी तमअचिके किपो जमाजाँचि किके थलयके भकेजमा थमा। कववकेचिकि नके यह भदी ममानमा हहै ककि बरमामदगदी सके पलवर उसनके अकभय किमा किपोई कडस्क्लपोजर स्टकेटमकेन्ट नहहीं थलयमा थमा। इस सम्बन्ध मम कवथध व्यवस्थमा 1997, एस.सदी.सदी. (कक्रकमनल) 651 एस 0 सदी0 जसकिरन बनमाम रमाजस्थमान रमाज्य मम ममाननदीय सवर्वोच्चि न्यमायमालय नके यह अकभकनधमा र रत ककियमा हहै ककि यकद अकभय किमा कडस्क्लपोजर स्टकेटमकेन्ट किके अभमाव मम अकभय किपो सजमा नहहीं किकी जमा सकितदी। ऐसदी लस्थकत मम यह समाकबत नहहीं हपो पमातमा ककि उक्त तमअचिमा किमा प्रयपोग प्रश्नगत हत्यमा किमाररत किकी घटनमा मम हहआ हपोगमा।"
In view of the aforesaid facts and circumstances of the case, it cannot be said that the view taken by the Court below is not possible and plausible thus the judgment of the court below cannot be interfered with by this Court only on account of the fact that another view is possible.
Learned A.G.A. has not been able to point out any illegality or perversity with the findings as recorded by the court below and thus it cannot be said that the view taken by trial court is a perverse view.
Thus in view of aforesaid consistent legal position as elaborated above and also in view of the fact that learned A.G.A. has failed to point out any illegality or perversity with the findings so recorded in the impugned order, no case for interference has been made out. No interference with the impugned judgment and order of acquittal is warranted. Accordingly the application seeking leave to appeal is rejected. Consequently, appeal is also dismissed.
Let a copy of this order be certified to the court concerned for necessary compliance.
