Heard learned counsel for the petitioners and learned Standing Counsel for State-respondents.
The present petition has been filed for direction upon the In-charge District Judge, Rampur to release/handover demand draft to the petitioners on the application moved by the petitioners.
The grievance of the petitioners is that the Presiding Officer of the court in which the execution proceeding is pending is currently not available and therefore the matter is unnecessarily being delayed.
Be that as it may, in case the court is vacant, the petitioners can move an application before the District Judge concerned for transfer of the proceedings to another court, which may be available or may take such other appropriate remedy as may be advised. Accordingly, no specific direction need be issued, at this stage.
With the aforesaid liberty, the petition is disposed off.
