Matter is taken up today in the National Lok Adalat. Parties are agreed to settle the dispute arising out of Motor Accidents Claims Case No. 844 of 2008 on the basis of compromise filed today on the following terms and conditions:-
(i) The respondent nos. 1 and 2 shall be entitled to get Rs. 2,00,000/- (Two Lacs and interest thereon Only) in full and final satisfaction of their claim from appellant Oriental Insurance Company Limited. The deposited amount deposited in compliance of interim stay order dated 10.11.2010 in addition to the amount of Rs. 2 Lacs, which they had already received and remaining amount alongwith interest thereon will be refunded to the appellant Insurance Company.
(ii) The amount already deposited/ received shall be adjusted towards the total amount due.
(iii) The amount due as above shall be deposited/paid through cheque within 30 days from the date of receipt of copy of the order of the Hon'ble Court failing which interest @ 12% P.A. shall accrue from such date till payment.
The appeal is accordingly decided in terms of compromise dated 09.12.2017. Compromise filed today shall form the part of judgment and award. Award be drawn accordingly.
A copy of this order be sent to the court concerned for necessary compliance.
