Matter is taken up today in the National Lok Adalat. Parties are agreed to settle the dispute arising out of Motor Accidents Claims Case No. 154 of 2009 on the basis of compromise filed today on the following terms and conditions:-
(i) The respondent nos. 1 shall be entitled to get Rs. 1,00,000/(One Lac Only) along-with 6% P.A. interest from the date of filing of the claim petition in full and final satisfaction of his claim from appellant Oriental Insurance Company Limited.
(ii) The amount already deposited/ received shall be adjusted towards the total amount due.
(iv) The amount due as above shall be deposited/paid through cheque within 60 days from the date of receipt of copy of the order of the Hon'ble Court failing which interest @ 12% P.A. shall accrue from such date till payment.
(iii) Any appeal/ cross objection filed by the claimant shall be deemed to be dismissed as not pressed.
The appeal is accordingly decided in terms of compromise dated 09.12.2017. Compromise filed today shall form the part of judgment and award. Award be drawn accordingly.
A copy of this order be sent to the court concerned for necessary compliance.
