- This is an application for recall of the order dated 10.2.2015, whereby criminal revision was dismissed .
- It is stated in the affidavit filed in support of recall application that applicants-revisionists were not aware of subsequent developments, i.e. respondent no. 2 Ram Pyari died on 24.11.1999 and dispute was already decided by Deputy Director Consolidation, Mahoba vide order dated 31.10.2012 in favour of applicants-revisionists, where against the matter is pending before this Court.
- In view of above, order dated 10.2.2015 directing matter to be decided by concerned authorities, needs be recalled.
- Accordingly, application is allowed and the order dated 10.2.2015 is hereby restored.
