The present application has been filed by the complainant seeking special leave to appeal against the judgment and order dated 21.09.2021 passed by the court of learned Additional Session Judge/FTSC (POCSO), Rudrapur, Udham Singh Nagar in Special Sessions Trial No.377 of 2017, “State Vs. Balkar Singh and another”, whereby the learned Trial Court has acquitted the Respondent No.2 – Sri Balkar Singh and Respondent No.3 – Smt. Rani Kaur. 4. Learned counsel for the Appellant states at the outset for consideration of the present special leave to appeal is that despite having sufficient evidence for charges of incident leading towards conviction, the evidence was not appreciated by the learned Trial Court, and thus, the present special leave to appeal. 5. After hearing the learned counsel for the Appellant, the present matter needs deliberation, this Court is satisfied that the Appellant has made out a prima facie case warranting consideration. Special leave to appeal is granted. 6. The application is treated as an appeal and is admitted. 7. Issue notice to the Respondent Nos.2 and 3. Steps to be taken within a week. 8.
