the prayer to set-aside/quash the charge
sheet dated 04.10.2023, cognizance order
dated
17.10.2023
and
the
entire
proceedings of Special Sessions Trial No.43
of 2023, pending in the Court of learned
Special
Sessions
Judge
(POCSO
Act),
Chamoli (Gopeshwar) on the basis of
compromise between the parties.

An
F.I.R.
was
lodged
by
the
complainant alleging that the applicant had
enticed away her minor daughter from her
lawful
guardianship.
Subsequently,
the
victim was recovered from the company of
the applicant, and upon completion of
investigation, a charge sheet was submitted
against him. It is stated in criminal misc.
application that, during the pendency of the
proceedings, the applicant and the victim
solemnized
their
marriage
and
duly
registered the same under the Uniform Civil
Code on 05.10.2022. The date of birth of
the victim is recorded as 14.09.2007, and it
is asserted that she had attained the age of
majority at the time of marriage. In her
statements recorded during the course of
investigation, the victim has categorically
stated that she had accompanied the
applicant of her own free will and without
any coercion or inducement.
