The petitioner is before this Court expressing certain apprehensions that on account of external factors which delayed his promotion to Joint Commissioner, Grade 2 would be put against him.

There is nothing on record to suggest that the Department Selection Committee has either ignored the petitioner, or has interpreted or drawn up any proceeding holding that the petitioner is not eligible to be considered for the post of Joint Commissioner, Grade 1 on account of his late entry to the feeder post of Joint Commissioner, Grade 2.

Be that as it may, we are of the opinion that the instant writ petition could be disposed of by permitting the petitioner to submit a representation to the Department Selection Committee with a copy to the respondent No. 2. If such a representation is made, the Department Selection Committee shall consider the same in accordance with law, and in the event, the petitioner is entitled to be considered in law, the Department Selection Committee shall consider the case of the petitioner along with all eligible candidates. In the event, the petitioner is not entitled to be considered, the Department Selection Committee shall assign reasons and dispose of the representation expeditiously at any rate before concluding the exercise for recommending promotion to the post of Joint Commissioner, Grade 1.

1. The writ petition stands ordered accordingly.

As a sequel thereto, pending application, if any, shall stand closed.
