Present applicant Vivek Singh, S/o Samandar Singh is praying for bail in relation to FIR dated 18.05.2025, bearing FIR/Case Crime No. 78 of 2025, registered at P.S. Dalanwala District Dehradun wherein nine persons were implicated for the offences punishable under Sections 318(4), 61(2) of BNS 2023 read with Section 3, 4, 10, 11 of the Public Examinations (Prevention of Unfair Means) Act 2024. 4. It is submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated which is evident from the fact that applicant is not named in the FIR. Apart from this, she submits that most of the persons who are named in the FIR have been enlarged on bail by the Trial Court. She further submits that co-accused, namely, Shrikant having similar role has already been granted bail by this Court on 14.07.2025, therefore, the present applicant is entitled for bail on the ground of parity. She further submits that the applicant has no previous criminal history. 5. On the other side, Mr. V.S. Pal, learned A.G.A. has not disputed this fact that the role, as assigned to the present applicant is identical to the co- accused Shrikant who has already been

enlarged on bail by this Court on 14.07.2025 in BA1 No. 1050 of 2025, and it is a case of parity. 6. Having heard learned counsel for the parties and further taking into consideration that the role assigned to the present applicant is identical to the co-accused Shrikant who has been granted bail by this Court on 14.07.2025, therefore, this Court is of the view that the present applicant is deserve for bail on the ground of parity. 7. Accordingly, without expressing any opinion on the merits of the case bail application is allowed. 8. Let the applicant “Vivek Singh” be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
