Petitioner
is
a
resident
of
Tugalpur,
Block
Khanpur, Tehsil Laksar, District Haridwar. According to
him, public land comprised in Khasra Nos. 418, 419,
420, 421, 422, 432, 441 and 487, which is recorded in
Revenue Records as public utility,_banjar_etc., has been
encroached upon by certain unscrupulous persons, and
the Revenue Authorities are not taking any action for
removing such encroachments.

Counsel
was
asked
to
get
instructions.

Today, Mr. Amarendra Pratap Singh, learned
Additional Advocate General, has produced in Court
written
instructions
received
by
him
from
Sub-
Divisional Magistrate, Laksar, which is taken on record.
Based on the written instructions, learned State
Counsel submits that part of the Khasra Numbers,
indicated by petitioner in the Writ Petition, have been
encroached by certain persons, and proceedings for
eviction of such unauthorised occupants have been
initiated
under
Section
122-B
of
Uttar
Pradesh
Zamindari
Abolition
&
Land
Reforms
Act,
1950.
Learned State Counsel, on instructions, submits that all
unauthorised
occupants
shall
be
removed
upon
conclusion of the proceedings under Section 122-B.

6. We, therefore, dispose of this Writ Petition by
taking the statement made by learned State Counsel
on record, with a direction to the competent authority
to clear all public land, within Village Tugalpur, Block
Khanpur, Tehsil Laksar, of encroachment, as soon as
eviction proceedings are concluded.
7. Consequently, pending application(s), if any, also stand disposed of.

We, therefore, dispose of this Writ Petition by

taking the statement made by learned State Counsel

on record, with a direction to the competent authority

to clear all public land, within Village Tugalpur, Block

Khanpur, Tehsil Laksar, of encroachment, as soon as

eviction proceedings are concluded.

Consequently, pending application(s), if any, also
stand disposed of.
