that the Laghu Urja Pariyojana Adhikari (UREDA), Haldwani, Nainital had been impleaded as a party respondent in the writ proceedings, vide order dated 30.12.2012. In pursuance of the same, the amended memo of parties was filed by the counsel for the appellants. However, no notice was issued to UREDA, electricity generating company, with whom the appellants had an agreement for managing the transmission lines. Consequently, UREDA remained unrepresented, despite being impleaded as a party respondent, and no counter affidavit was filed by them. They did not appear before the learned Single Judge to defend the Writ Petition. 6. Pertinently, UREDA has not assailed the impugned judgment on the aforesaid ground, despite being impleaded as a party respondent. At the instance of the appellants, i.e. Urja Samiti Ramgarh, District Nainital acting through its Secretary and President, we are not inclined to entertain the said ground, since the said Urja Samiti was duly represented before the learned Single Judge. Pertinently, they had also filed their counter affidavits in their defence. 7. We do not find any infirmity or illegality in the impugned judgment. 8. The present Special Appeal is, accordingly, dismissed. 9. Consequently, pending application(s), if any, stand disposed of accordingly. ( Rak esh Th apliy al, J.)
