The applicants Sharafat and Noor Mohammad @ Hathi, who are in Jail in connection with Case Crime No. 193 of 2023, under Sections 3, 5 & 11 of the Uttarakhand Protection of Cow Progeny Act, Sections 3/11 of the Prevention of Cruelty upon Animals Act and Sections 353 & 332 IPC, Police Station Kotwali Gangnahar, District Haridwar, have sought their release on bail. 4. Heard learned counsel for the parties and considered the grounds taken up in the bail application. 5. The applicants are in incarceration with effect from 14.04.2023. It has been submitted by the learned counsel for the applicants that the applicants have been falsely implicated in the aforesaid crime and they are innocent. They have been made scape goat. 6. From perusal of the FIR, it is reflected that 165 Kgs. beef along with the head of a slaughtered cow, knife and the equipments meant for cow slaughter were recovered by the Police from the spot and both the applicants were caught from the spot. 7. Since all the offences are triable by Magistrate and the applicants are under incarceration since 14.04.2023, |
