By filing this writ petition, the petitioner has prayed as follows:-

(i) Issue a writ order or direction in the nature of certiorari quashing order of impugned rejection order dated 13.10.2022 passed by respondent no. 3 (Annexure No. 1 to the writ petition).

(ii) Issue a writ order or direction in the nature of mandamus directing respondent no. 4 to issue OBC’s certificate in favour of the petitioner.

2. I t is borne out from the record that the petitioner belongs to ‘Islam Mochi’ caste, which is enlisted as Other Backward Class (OBC) category in the State of Uttarakhand. She took birth after formation of the State of Uttarakhand. Petitioner is born in the State of Uttarakhand on 10.01.2013. She has been granted Permanent Resident Certificate by the Tehsildar, Kiccha, Udham Singh Nagar (Annexure No. 3 to the Writ Petition), but her application for grant of OBC caste certificate has been rejected on the ground that it

does not confirm the requirements as per G.O. 1985. However, paragraph No. 4(iii) of the G.O. dated 02.04.2013 bearing No. 1118/XVII-1/201301(20)/2013 provides that ‘permanent resident’ shall be a person, who took birth in the State of Uttarakhand after 09.11.2000 and whose parents are satisfying the qualification given in Paragraph No. 4(i) of the aforesaid G.O., which reads as follows :-

However, this Court is of the opinion that when a person is born in the State of Uttarakhand, after its creation and residing permanently there, then he shall be included in the category of ‘permanent resident’ and the requirement of the G.O. that his/her parents should have permanent house in the State of Uttarakhand has to be read down.

In that view of the matter, in this case, the petitioner qualifies all the criteria for grant of OBC caste certificate, hence, the writ petition is allowed and the Tehsildar, Tehsil Kiccha, District - Udham Singh Nagar – respondent no. 3 is directed to reconsider the matter and after affording reasonable opportunity of hearing

and producing the documents to the petitioners to establish their case, in terms of the provisions referred to above, shall take a decision strictly, in accordance with law, by speaking and reasoned order within a period of 21 days from production of certified copy of this order.
