This writ petition was disposed of by this Court by the judgment dated 01.07.2020, on the basis of a statement, made by the learned counsel for the respondents that the matter stands covered by an earlier judgment rendered on 26.02.2020, in Writ Petition (S/S) No. 311 of 2020, pertaining to the payment of the gratuity and leave encashment. It is after the expiry of more than one year, a Time Extension Application (MCC/1/2021) has been filed by the respondents. During the arguments, the learned counsel for the petitioner has informed that seeking compliance of the judgment dated 01.07.2020, he has filed a contempt petition being Contempt Petition No. 237 of 2021, on which the notices have already been issued to the respondents. In such an eventuality, where the contempt proceedings have already been initiated for non-compliance of the order dated 01.07.2020, no extension, as such, could be granted, as prayed for by the respondents. Hence, in these peculiar circumstances, the Time Extension Application cannot be considered by this Court The Time Extension Application is rejected accordingly.
