Petitioner no. 1 before this Court is a college, namely, “Dev Bhoomi Medical College of Ayurveda & Hospital”, which imparts education in Bachelor of Ayurveda, Medicine and Surgery (in short “BAMS”) and the petitioner no. 2 is the Chairman of the said college. This matter relates to the admission of students in BAMS under-graduate course for the academic year 2019-20.
This Court has been apprised that similar matters have already been decided by a Division Bench of this Court on 16.10.2019, wherein the action on the part of the Central Government, which has not considered the inspection report and passed an order rejecting the claim of the Ayurvedic Colleges was held to be not in accordance with law and consequently the Division Bench has set aside the orders passed by the AYUSH.
Learned counsels for both the parties agree that this matter is squarely covered by the aforesaid decision of the Division Bench of this Court passed in Special Appeal No.941 of 2019 and other connected matter, decided on 16.10.2019.
In view thereof, the present writ petition is also disposed of on the same terms and conditions as passed by the Division Bench of this Court Special Appeal No.941 of 2019 and other connected matter, decided on 16.10.2019.
