This writ petition was finally decided on 08.07.2019 after hearing the learned counsel for the petitioners Mr. Rajesh Joshi, who was the then counsel appearing on behalf of the petitioners.

A review application has been filed along with the Delay Condonation Application of 40 days.

The review application is being opposed by the respondent. However, taking a pragmatic view with regards to the delay, filed in support of the review application, the delay is condoned. Accordingly, the Delay Condonation Application is allowed.

As far as the review is concerned, it is on the ground that the certain facts and grounds which were available on record, they were not pressed into by the earlier counsel who had appeared on behalf of the petitioner, that in itself will not amount to be an apparent error committed by the Court. If the counsel chooses to argue only a few specified grounds and the manner in which it has been argued, that itself cannot be a ground for reviewing the judgement, apart from the fact that this Court also deprecates the filing of a review with the changed counsel, which is not permissible in view of the judicial pronouncements of the Hon’ble Apex Court.

Consequently, this Court does not find any merit in the review application. Accordingly, the review application is rejected.
