The writ petition arises out of the proceedings under the Public Premises Act, whereby, the petitioner has been concurrently held by the Court below to be unauthorized occupant and, thus, eviction has been directed against him.
Petitioner has preferred this petition challenging the orders dated 25th February, 2006 and 26th June, 2006, passed by the Prescribed Authority as well as District Judge, Rudraprayag respectively.
There is no interim order in the writ petition. The writ petition was dismissed for want of prosecution on 24.11.2008. Subsequently, it was restored on 1st April, 2010.
Today, the writ petition is taken up in the revised call. In both the rounds, counsel for the petitioner has not put in appearance.
Keeping in view that the matter pertains to freedom fighter, who claims himself to be member of Indian National Army, the case yet again posted after lunch. None appears to press the writ petition.
The writ petition is dismissed for want of prosecution.
