The applicant has moved this bail application seeking regular bail in connection with Case Crime No.219 of 2016 under sections 304, 308 IPC, registered on the basis of the FIR dated 06.09.2016 at Police Station Doiwala, District Dehradun.
Learned counsel for the applicant submits that twice applicant was granted short term bail. He submits that applicant has no criminal history; he is in jail since 19.09.2016. He submits that co-accused Dhiraj Tomar having similar role has been granted regular bail by this Court. He submits that this is a case of parity and on the basis of parity applicant is also entitled for bail.
Having considered submission of learned counsel for the applicant and without expressing any opinion as to final merits of the case, this Court is of the view that applicant deserves bail.
Accordingly, the bail application is allowed. Let applicant be released on bail on executing personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Magistrate concerned. Urgency application stands disposed of.
