WPSS No. 1771 of 2016
Hon’ble Sudhanshu Dhulia, J.
Mr. Ghanshyam Joshi, Advocate present
for the petitioner.
None present for the respondents/Union of India.
Before arguing the case on its merit, a statement has been given by learned counsel for the petitioner at bar that this writ petition has been filed due to inadvertent mistake, as Sports Authority of India is notified under Section 14 of the Administrative Tribunal’s Act by the Central Government.
In view of the statement made by learned counsel for the petitioner, hence, the petitioner has an alternative remedy to first approach Central Administrative Tribunal, particularly in view of the Constitution Bench Judgment in the case of L. Chandra Kumar Vs Union of India reported in AIR 1997 SC 1125 . This writ petition is not maintainable in the first instance before this Court.
Accordingly, the writ petition is hereby dismissed on the ground of alternative remedy.
