Applicant seeks bail in connection with Case Crime No.382/2014 under Sections 489(B) and 489(C) IPC, P.S. Rishikesh, District Dehradun.
Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application.
Eight fake Indian currency notes of the denomination of Rs.500/- were allegedly recovered from the possession of applicant in Rishikesh. The Sessions Judge, Dehradun in his order dated 29.01.2015 has put a remark that there is every possibility of the applicant to abscond from trial. It has been stated in the affidavit of applicant’s wife that the applicant is in jail since 15.12.2014 and is an employee of the Entertainment Department, Murshidabad, West Bengal. It is also stated that the applicant came to visit Rishikesh, but due to the altercation with the local police, he was falsely implicated in the crime.
Considering the facts and circumstances, a case of bail is made out in favour of the applicant. Bail application is allowed.
Let the applicant be released on bail on his executing a personal bond and furnishing two reliable sureties, of the like amount, to the satisfaction of the Magistrate concerned.
If, at any point of time, it is found that the applicant is misusing bail, it will be open to the court below to cancel the bail of the applicant after giving him due opportunity of hearing.
