Applicant seeks bail in connection with Case Crime No. 286/2014 under Sections 365, 302, 201 IPC, P.S. Kotwali Gangnaher, Roorkee, District Haridwar.
Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application.
The applicant, who is in jail since 18.09.2014, was named in the FIR. It was alleged in the FIR that the victim, who was aged about 18 years and was a student of Class-XI, was missing since 16.09.2014 and he was last seen in the company of present applicant. The evidence against the applicant collected by the I.O. is the confessional statements of applicant and coaccused and the dead body of the victim was found on their pointing. The confessional statement of the applicant was read over by learned Deputy Advocate General to highlight the involvement of the present applicant in the crime. The cause of the death of the deceased was cardio-respiratory failure due to internal haemorrhage by trauma. The recoveries were made from accused persons jointly and coaccused named in the FIR had already been directed to be enlarged on bail by this court vide order dated 15.4.2015.
Considering the facts and circumstances, a case of bail is made out in favour of the applicant. Bail application is allowed.
Let the applicant be released on bail on his executing a personal bond and furnishing two
sureties of the like amount, to the satisfaction of the Magistrate concerned.
