Present writ was filed petition seeking writ of certiorari to quash the impugned voter list and to issue writ of mandamus to hold election of the Committee of Management of RMPPV Inter College Gurukul Narsan, District Haridwar on the basis of undisputed voter list.

Undisputedly, after filing of the writ petition, election of the Committee of Management of RMPPV Inter College was held on 18.02.2014.

In the considered opinion of this Court, if election were held on the basis of the invalid voter list or in other words some ineligible voters were allowed to cast vote or legitimate voters were denied to cast vote, in that event, election so held on 18.02.2014 can be challenged either under Section 25 of the U.P. Society Registration Act or by way of filing regular civil suit before the Civil Court in view of the fact that proceedings under Section 25 of the U.P. Society Registration Act is of summary in nature.

Since election has already been held, therefore, present writ petition has rendered

infructuous. Therefore, same is according dismissed. However, petitioner shall be at liberty to challenge the election on the ground available to the petitioner. CLMA No. 14241 of 2013 stands disposed of accordingly.
