Counter affidavit filed by learned counsel for the respondent is taken on record. Application made therefor stands disposed of.

The applicants were summoned to face the trial for the offences punishable under Sections 323, 504, 506, 427 and 392 of IPC.

At the very outset, learned counsel for the applicants did not press the present application under Section 482 Cr.P.C. on merits and instead, made a prayer to direct the Court below to decide the bail application of the applicants on the same day, subject to their surrender.

Considering the facts of the case, the innocuous prayer made by the learned counsel for the applicants is worth accepting.

Application under Section 482 Cr.P.C. is disposed of summarily by directing that the applicants shall surrender before the learned Magistrate within three weeks, whereafter, they will be dealt with by the learned Magistrate according to law. No coercive measures shall be taken against the applicants to enforce their attendance before the trial court for a period of three weeks.

It is further provided that if the applicants surrender before the trial court and seek bail, their bail application (s) shall be decided on the same day in the criminal complaint case.
