Mrs. Neetu Singh, learned counsel for the petitioners and Mr. Abhishek Verma, learned counsel for the respondent no. 2 submitted that with their consent Criminal transfer application no. 25 of 2014 has already been allowed today, therefore, present transfer application no. 23 of 2014 should also be disposed of today.

On their joint request C 407 No. 25 of 2014 was summoned, taken up on the board and is being disposed of.

Mr. Abhishek Verma, learned counsel for the respondent no. 2 has no objection if Criminal Case No. 54 of 2014 (State vs. Vibha Devi and others) under Section 147, 148, 2323, 504, 506, 452, 427 IPC P.S. Pathri District Haridwar is transferred for the trial to any competent Magistrate at Roorkee.

Without entering into the controversy and in the allegation of bias in view of the statement made by learned counsel for the respondent no. 2, present application, thus, is disposed of with the direction that Criminal Case no. 54 of 2014 (State vs. Vibha Devi and others) under Section 147, 148, 2323, 504, 506, 452, 427 IPC P.S. Pathri District Haridwar pending in the Court of Judicial Magistrate-I, Haridwar shall stand transferred

to the Court of ACJM, Roorkee for disposal in accordance with law. Judicial Magistrate-I, Haridwar is directed to transfer the record forthwith. Parties shall remain present before the ACJM, Roorkee on 30.11.2014 for further orders.
