An FIR was lodged against five named accused, including the applicant, for the offence punishable under Section 364 of IPC, with the inclusion of Sections 302, 120B, 201, 384 of IPC later on.
Learned counsel for the applicant stated that the evidence of eight prosecution witnesses has been recorded by the trial court.
After arguing the bail application at some length, learned counsel for the applicant seeks to withdraw the bail application with liberty to move application under Section 437(7) of Cr.P.C. before the trial court.
In view of above statement, the third bail application is disposed of as withdrawn with liberty to the applicant to move an application under Section 437(7) of Cr.P.C. before the trial court at an appropriate stage.
