Applicant Ishtkar, who is in jail in connection with Case Crime No. 02 of 2014, relating to offences punishable under Sections 420, 468, 471 and 411 of IPC, Police StationRajpur, District- Dehradun, has sought his release on bail.

Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application.

SHO, Rajpur, while on vehicle checking duty, was informed by another police officer that two vehicles coming from Mussourie, have fake registration papers. Upon checking, the forged registration numbers were found on the cars. Present applicant was said to be bona fide purchaser for value. His bail application was dismissed by the learned Sessions Judge on the ground that he was the direct beneficiary of the act of cheating, but the co-accused Meharban, who was also sitting along with the present applicant was granted bail by learned In-charge, Sessions Judge, Dehradun vide order dated 11.02.2014. Co-accused Devki Nandan Bhatia was also granted bail by the said Court. Present applicant has no previous criminal history and he is in jail since 04.01.2014. Learned counsel for the applicant submitted that the applicant is ready to furnish local reliable sureties, if he is ordered to be enlarged on bail.

Considering the facts of the case and attenuating circumstances, a case of bail is made out in favour of the applicant.

Accordingly, the bail application of the applicant is allowed. Let the applicant Ishtakar be released on bail on his executing a personal bond and furnishing two local reliable sureties, each of the like amount to the satisfaction of Chief Judicial Magistrate, Dehradun.
