Heard learned counsel for the parties and perused the record.

By way of instant petition, the petitioner has challenged the order dated 15.09.2013 passed by respondent no.3, so far as it relates to the petitioner.

It is contended on behalf of the petitioner that from 01.01.1991 to 22.08.1995, the petitioner worked in Govt. Primary School, Maikura in District Chamoli, which is situated in Ati Durgam area. Thereafter, again the petitioner worked from 10.11.1995 till 22.08.2001 in Govt. Primary School, Kalsi Bazar, Boys, Dehradun which is also situated in Durgam place, but while considering the case of the petitioner for her transfer, the respondents have not taken into consideration this fact and wrongly awarded her marks, treating these two colleges under ‘C’ category colleges. He submitted that had the calculation been done in proper manner, the petitioner could not have been transferred to a remote place.

Learned Standing Counsel for the State submits that Rule 26 in the Transfer Rules provides right to appeal and the petitioner can file appeal, which shall be decided in accordance with law. On this, the counsel for the petitioner states that the petitioner has already submitted representation on 26^th September, 2013 but no decision has yet been taken.

Considering the submissions of the counsel for the parties, the writ petition is disposed of by directing the competent

authority to take decision on the representation of the petitioner, filed under the Transfer Rules, within a period of 15 days from the date of production of a certified copy of this order. This disposes of the writ petition. Stay application also stands disposed of.
