By means of this writ petition, the petitioner has sought a writ in the nature of mandamus commanding District Judge, Dehradun to hear and decide the Small Cause Revision No. 29 of 2010, Smt. Renu Jain Vs Ravindra Jain & others expeditiously.
Learned counsel for the petitioner contended that suit was decreed after ten years of its institution. Thereafter revision was preferred in the year 2010. The respondents, on one ground or the other, sought adjournment on one ground or the other and are enjoying the stay order. Therefore, the direction be given for expediting the Small Cause Revision No. 29 of 2010. The prayer made is innocuous in nature.
Considering the facts and circumstances of the case that has been brought on record, I dispose of the writ petition directing District Judge, Dehradun to decide the Small Cause Revision No. 29 of 2010, Smt. Renu Jain Vs Ravindra Jain & others as expeditiously as possible preferably within one year from the date of production of a certified copy of this order, after hearing both the parties. It is further directed that unnecessary adjournments shall be avoided and the parties are also directed to cooperate in the expeditious disposal of the case.
