Learned counsel for the petitioner submits that after investigation, police filed final report stating therein that no offence is made out, however, despite non filing of protest petition either by the complainant or prosecutrix, learned Magistrate, suo moto, took cognizance on the final report filed by the police and committed the case to the court of Session. He further contends that in the present case, prosecutrix has refused to get her statement recorded under Section 164 Cr.P.C. and has also filed an affidavit duly verified by the DSP to the effect that no crime was committed against her.

Learned counsel for the petitioner seeks permission to withdraw this petition, at this stage, with liberty to raise all the legal and factual points before the learned trial court, at the time of framing of charge seeks discharge.

Permitted to be withdrawn with aforesaid liberty. CRMA No. 594 of 2013 and IA No. 2058 of 2013 also stand disposed of.
