This is an application seeking regular bail in CBI Case No. 01 of 2013 (FIR No. RC0072011A0006) CBI vs. Satpal and others under Sections 120-B, 420, 467, 468 & 471 IPC and Sections 7, 8, 12 & 13(2) read with Section 13(1)(d) of Prevention of Corruption Act, 1988, Police Station CBI, SPE Dehradun.
Perusal of the charge-sheet would reveal that bribe was paid to Satpal (DIG). The only allegation against the applicant is that he has replaced the answer-sheet and done some manipulation. DIG Satpal has already been enlarged on bail by the learned trial court vide order dated 03.03.2012 under Section 167(2)(a)(i) of the Code of Criminal Procedure.
Mr. L.K. Tiwari, learned counsel for the applicant submits that applicant was not arrested during the investigation and after submission of charge-sheet, has himself surrendered before the learned trial court.
Considering the totality of the facts and circumstances of the case. Bail application is allowed. I direct, let the accused/applicant be released on bail on furnishing his personal bond of `50,000/- and two sureties of like amount, to the satisfaction of Special Judge, CBI, Dehradun.
