By the present writ petition, the petitioner has prayed for a writ of mandamus commanding the respondent no.1 to expedite and conclude the application under Order 9 Rule 4 C.P.C. i.e. Misc. Case No. 78/01, the substitution application and O.S. No. 314 of 1995 Jagmindar Versus Suchcha Singh within a period of one month or at the earliest.
The grievance of the petitioner is that the suit relates to the year, 1995 and is pending since then.
In view of the aforesaid facts and circumstances, the Civil Judge (Jr. Division), Dehradun is directed to dispose of the aforesaid suit within a period of six months from the date of production of the certified copy of this order.
Writ petition is disposed of. No order as to costs.
