The applicant has applied for bail in case crime No. 737/2006, U/S 420 I.P.C. Police Station Kichchha, District Udham Singh Nagar.
Heard Sri H.M. Sethi, learned counsel for the applicant, learned A.G.A. and perused the record.
The record reveals that the Chief Medical Officer, Udham Singh Nagar deputed the District Homeopathic Officer, Rudrapur to inspect the Institute titled as "Om Research Institute and Electropathy, Hospital, Rudrapur Road, Bangali Colony, Rudrapur. When the team reached over there, it came to know that the Institute was being run without having any authority either by the Government or by the Medical Council. The applicant posted himself to be the Director of the Institute, but at the same time he was found to be the student of that very Institute. The applicant also could not show any document maintained by the Institute with regard to the payment of the fee etc or the documents pertaining to the other affairs of the Institute. The inspecting team also could not get any of the teacher in the alleged College.
Having considered the aforesaid aspects, I am of the view that the applicant is involved in running the Institute without having any proper authority from either the State Government or the Medical Council. The applicant is thus involved in the serious social offence. I do not find any ground for enlarging the applicant on bail at this state.
The bail application is hereby rejected.
