| B E F O R E THE HON’BLE MR. JUSTICE S.TALAPATRA 01.08.2017 Mr. Somik Deb, learned counsel appearing for the petitioner has submitted that the petitioner has already been appointed as the Executive Engineer as on current duty charge and as such the substantive relief has been granted. Ms. AS Lodh, learned Additional Government Advocate has submitted that in view of the stay order passed by the Supreme Court in a case where the constitutionality of Rule 9(2) of the Tripura Scheduled Caste and Scheduled Tribe Reservation Rules, 1992 is an issue the State government is not in a position to consider the promotion of the petitioner unless the stay order is vacated or the matter is decided finally. In view of the statement made by Ms. Lodh, learned Additional GA, the respondents are directed the moment the impediment as indicated is removed, the petitioner’s case may be considered for promotion to the post of Executive Engineer in accordance with law as expeditiously as possible. In terms of the above, the writ petition is disposed of. JUDGE |
